Compliance
The Authority conducts environmental compliance monitoring and audit in collaboration with other stakeholders such as lead agencies to continuously measure, evaluate and track;
Unless otherwise specified by the Authority or lead agency in writing, or in conditions in permits, licences or other approvals, a developer shall undertake the monitoring in a regular and timely manner and with a frequency and manner commensurate with the nature of the project.
Enforcement
The Authority, an authorised officer or an environmental inspector shall be responsible for the enforcement of an environmental improvement notice or environmental compliance notice or a restoration order.
The Authority shall, upon detecting any non-compliance by a developer with the requirements, notify the developer in writing and require the developer to bring the project to comply with the requirements of the National Environment Act Cap 181 and relevant regulations.
A developer is required to maintain proper records of the monitoring which shall be made available to the Authority or lead agency upon request. A lead agency or the Authority may require the developer to submit monitoring reports in a prescribed form. An environmental compliance certificate will be issued.
A person who wishes to request for the review of an environmental improvement notice or environmental compliance notice may apply to the Authority within twenty-one days of service of the environmental improvement notice or environmental compliance notice or restoration order.
